Terms of Use
General
The Bring Them Home Now Site, at the address https://solidarity.bringthemhomenow.net ( the “Site”), is operated by the Hostages and Missing Families Forum R.A. Registration number: 580775674 (the “Forum” or “Us”).
These Terms of Use (the "Terms") settle the relationship between the Forum and any person visiting and/or making use of the Site (“User” or “you”) including, but not limited to making purchases via the Site. In any case of contradiction or discrepancy between these Terms and any other terms, provisions, publications on any other media, the provisions of these Terms shall prevail.
The availability of the information, content and services on the Site is not constant, and sometimes even subject to the provisions of the law or agreements of the Forum and/or anyone on its behalf with third parties. Accordingly, the Forum shall have the right, at its exclusive discretion, to update and/or cancel and/or remove any specific service, product or content from the Site, from time to time, immediately and with no prior notice and subject to any applicable law, and the you will not have no complaint and/or demand in that regard.
The division of these Terms into sections and headings are for the sake of convenience only, and shall not serve for the interpretation thereof. Everything stated in this document in the singular also refers to the plural.
Site Use
The use of the Site and the content offered therein is given AS-IS and AS-AVAILABLE. All information and data contained on the Site, including information regarding products offered via the Site, are up-to-date and correct solely at the relevant date on which they were used.
Should you make use of the Site for another person or corporation, you agree and warrant that you have all the consents, permits and confirmations required to engage in the name of that person or corporation. You undertakes to indemnify the Forum and/or anyone on its behalf for any damage or loss that may be incurred by the Forum and/or anyone on its behalf as a consequence of any claim and/or demand made by any person or corporation for the use of the Site in their name by you.
Without derogating from the aforesaid, the Forum shall have the right to prevent any User from making any use of the Site in any of the following cases:
- The User an illegal act and/or contravened the provisions of the law;
- The User breached any of the Terms; and
- The User committed an action or omission which might harm the Forum and/or anyone on its behalf and/or any third party, including other users of the Site or disrupt the normal activity on the Site
Payments
All payments made via the Site will be transferred in full to the Forum (post deduction of associated third-party costs, payment and shipping fees and taxes, necessary for the continuing the operation of the project) and will be used for the ongoing needs of Forum, for any purpose, whatsoever. You shall have no claims against the Forum, Site or anyone operating on their behalf, relating to any usage of the funds resulting from your payment.
When ordering products via the Site, you may be required to give relevant details for the purpose of executing the order. You must ensure that the required details are accurate and current. If the details given are erroneous and/or out of date, the Forum cannot ensure that the order will be accepted and/or executed. The Forum will not bear any liability for any error made by you when inputting such data in connection with making an order.
In order to order any products or use any service offered on this Site, you must be over 18 years of age.
Any order of products made via the Site is subject to the Forum approval. The Forum reserves for itself the right to approve, reject or restrict any order, at its reasonable discretion in the circumstances of the case (e.g. - refusal by the credit card company, etc.), and no complaint and/or demand vis-a-vis the Forum in regard thereto shall be accepted.
A condition for executing orders via the Site is that the User holds a valid credit card (which has not been restricted or blocked for any reason). Should you make use of any third party's credit card, you hereby warrant that the said credit card is used with the full knowledge and consent of the registered owner thereof, and you shall bear exclusive liability and shall indemnify the Forum immediately for any claim and/or demand by the owner of the credit card or any third party vis-a-vis the Forum and/or anyone on its behalf in connection with your use of the said credit card.
If you are viewing the Site from Israel, the prices displayed are inclusive of VAT.
Depending on your delivery address, different taxation rules and additional charges may apply. If you are shipping items outside of Israel, you may need to pay import duties upon receipt of the products. You are solely responsible to pay for any taxes and levies that may apply on the payments, delivery and import of the products.
The Forum has the right to update the prices of the services on the Site from time to time, with no need for any prior notice. The price that is valid regarding an order made is the one published on the Site at the time the order process is completed. If the price is revised before the User completes the order process, the User will be charged at the new price. It is clarified that the price will not be changed regarding an order that has already been confirmed.
Delivery costs are not included in the prices and will be charged in addition, unless expressed otherwise by the Forum during the payments process. The delivery costs will vary depending on the product type and quantity that you have ordered and your delivery address. Depending on your delivery address, different taxation rules and additional charges may apply. You may need to pay import duties upon receipt of the products. The Forum does not have any control over these charges and therefore cannot advise on their amount.
Upon completion of the order, an order confirmation will be sent to you by e-mail (using the details given when the order is placed). If the order is not confirmed by the credit card company, you will receive an appropriate notice thereof when making the order, and you will be required to give an alternative means of payment or to give additional information, as the case may be. Receipt of order confirmation does not constitute the Forum's confirmation regarding the availability of the products or services, and the Forum reserves for itself the right, at its exclusive discretion, to cancel orders which it is unable to fulfil on the requested date and/or to contact you in order to alter the details of the order after execution thereof.
Cancellations and Return Policy
All payments made by Israeli Consumers (as defined under the Consumer Protection Law), to be delivered in Israel shall be subject to the Cancellation and Return policy available at: https://solidarity.bringthemhomenow.net/returns
All payments made by international consumer to be delivered internationally shall be subject to the following:
- The delivery of products to any location outside of Israel, depends on the availability of third party carriers. Some products may have restrictions for certain international destinations. If we are not able to fulfil an order, we will notify you and make a full refund or not charge, as applicable. When you order products for international delivery, you may be charged import duties and taxes when the package arrives at its destination. For more information on duties and taxes, please see section 3(g) above. You must comply with all applicable laws and regulations of the country where the products are being shipped. We are not responsible for any breaches of these laws.
- For any products which were not shipped yet, you may cancel your order at no charge, by providing a written notice of cancellation to us_support@bringthemhomenow.net
- For products shipped or received you may cancel your purchase, within 14 day of products delivery, by providing us a written notice of cancellation to us_support@bringthemhomenow.net , subject to the following: (a) The products are intact and have not been damaged or used and are return in their original boxing; (b) you have provided us with a notice up to fourteen days of receipt of the products; (c) you have shipped the products back to us and the products have been received in our facilities. In such case, the Forum shall refund you fully including any shipping costs (excluding any taxes or other delivery costs) charged at the time of payment. The Forum shall have the right to collect a cancellation fee at a rate no higher than 5% of the value of the transaction or ILS 100 - whichever is lower. It is clarified that the shipping costs paid by you in order to return products shall not be refunded.
Privacy Policy
Details given and/or collected for you pursuant to use of the Site, and any other data issued on the basis of analysis of these details and any information concerning any User that contacts the Forum, in the past and/or future, pursuant to the use of the Site or your engagement with the Forum, shall be subject to the provisions set forth in the Site’ Privacy Policy available at: https://solidarity.bringthemhomenow.net/privacy
Intellectual Property
All intellectual property rights (of any kind whatsoever), including trademarks, commercial secrets and copyright, whether registered or not, on the Site and any part thereof, including (and without derogating therefrom): content, design, and any software, application, computer code, graphic file, text and any other material contained on the Site, whether in external interface, source code or target code - belongs to the Forum alone and/or to third parties, as the case may be, and are protected by the copyright laws of the State of Israel, international treaties and the copyright laws of other countries, as the case may be.
Users are forbidden to insert changes, to copy, publish, distribute, display, perform, reproduce, issue a license, create derived works, do reverse engineering, or sell fully or partially, temporarily or permanently, in any way whatsoever, any part of the information and content contained on the Site without the prior written consent of the Forum and/or of those third parties (as the case may be). Furthermore, no use may be made of the Site in a manner that does or might constitute a breach or damage to the intellectual property of the Forum or (as the case may be) of those third parties, without the Forum's explicit prior written consent.
The trademarks on the Site are the property of the Forum or, to the extent published on behalf of third parties, including advertisers or business partners - the property of those alone. No use may be made thereof without the prior written consent of the Forum or (as the case may be) those third parties as aforesaid.
User Obligation
You undertake to make use of the Site, the information, content, services distributed or contained therein solely pursuant to the law and in accordance with the provisions of these Terms.
You undertakes not to link to the Site and/or use it and/or the information, content and services contained therein for the purpose of uploading, downloading, distributing, publishing or broadcasting (a) information or other material in a manner that may breach any rights, including intellectual property rights, privacy protection rights and/or any other property right; (b) other information or material that is illegal or is forbidden to publish or use, due to its being defined as a threat, offense, insult, libel, slander, racist or inappropriate content; (c) information or other material containing a virus or other malware that might sabotage the computer systems of the Forum and/or of any third parties, or in a manner that might restrict or prevent others from using the Site; or (d) information or other material containing any kind of advertising without the Forum's prior written consent.
You undertake not to make changes and/or to intervene in any way in the source code of the Site and/or the information and/or content contained therein, and not to upload any software and/or applications that might impair or cause damage to the Site and/or the Forum and/or any other third parties.
You agree that, without derogating from any of the Forum's other rights, in cases where the Forum might be concerned that the your use of the Site does not comply with these Terms and/or with any law, it shall have the right to discontinue your use of the Site's services, including by blocking the IP number, monitoring your use of the Site, notifying the relevant authorities and/or third parties of your behavior patterns which to the Forum’s satisfaction, that they have incurred damage from your breaching activity, and any other action which the Forum may deem fit to protect its property and/or rights and/or the rights of third parties.
Limitation of Liability
Without derogating from the aforesaid in these Terms, the Forum and/or anyone on its behalf shall not bear any liability or responsibility for any of the following:
Any indirect expense, loss or damage, whether consequential or circumstantial (including economic deficit, loss of profits, loss of business opportunity, damage to reputation, decrease in value, and the like), which may be caused to the User and/or any third party in connection with the use of the Site and/or any action or omission of the Forum and/or anyone on its behalf;
Any malfunction and/or delay and/or disruption of use of the Site (including, and without derogating from the generality of the foregoing, Bezeq lines and/or internet systems and/or cellular grids), as well as any expense, loss or damage which may be caused for any reason, independently of the Forum, including and without derogating, as a result of any order and/or regulation and/or directive of any government authority, substantial paralysis of communication systems, earthquake, storm, shortage of materials and/or public services and/or transportation services, fire, flood, detonation, explosion, accident, epidemic, strike, shut-down, riots, public disturbance, war, acts of terrorism and/or hostility and lock-down, all of which shall not be considered a breach of these Terms and shall not entitle the User to any relief and/or right. For the removal of doubt, and without derogating from the generality of the foregoing, it is clarified that the User shall have no complaint or any right in connection with any action taken by the Forum due to any such malfunction or disruption;
For any expense, loss or damage that may be caused in connection with any actions or omissions by the User and/or third parties, including and without derogating, communication providers (including in connection with any malfunction and/or disruption, temporary or permanent, of communication lines);
For any expense, loss or damage that may be caused to the User due to any update and/or cancellation and/or deletion of content from the Site and/or for taking down the Site (or blocking access thereto) for reasonable and acceptable periods of time for maintenance and/or upgrading purposes;
The continuous use of the Site depends on the accessibility, serviceability and survivability of the Internet and/or (as the case may be) the cellular communication network which, as is well-known, at some times and/or in some areas of the State of Israel, are not full and successive. The Forum and/or anyone on its behalf, shall not be liable for any deficit, expense, loss or damage, including special, consequential or indirect damage, caused in connection with any action or inaction of the Site, including (without derogating) in connection with any error, malfunction or technical or other failure in viewing the information;
The Site might contain inaccuracies or typos and other errors, and there is no possibility of preventing mistakes, defects and errors in the content and/or the manner of transferring them;
Communication networks, computers, servers and Sites are open to attacks and hacking attempts on the part of various entities. The Forum uses a number of security measures in order to preserve the privacy of the information inputted in the course of using the Site; however, the User should be aware that it is not possible to totally secure the information, and break-ins and hacking into the Site may occur. The Forum does not undertake that the Site shall be absolutely immune to unauthorized access to the information stored thereon. When surfing on the Site, and giving particulars, the User releases the Forum and/or anyone on its behalf from all liability for any damage that he and/or anyone on his behalf may incur due to attacks, attempts at breaking in and hacking the information as aforesaid, and waives any complaint against the Forum and/or anyone on its behalf in that regard.
Export Controls
You may not use or export anything (including information) from the Site in violation of U.S., Israeli or other applicable export laws, regulations or the Terms. You acknowledge and confirm that you are not: (a) a resident in a country or territory that is the target or comprehensive U.S. or Israeli economic or trade sanctions (currently, Lebanon, Cuba, Iran, Syria, North Korea, or the Crimea region of Ukraine), (b) identified on a list of prohibited or restricted persons, such as the U.S. Treasury Department’s List of Specially Designated Nationals and Blocked Persons, or (c) otherwise the target of U.S. sanctions. It is clarified that the Forum reserves the right to cancel any purchase made to the countries listed above.
Miscellaneous
The Forum reserves for itself the right to add, alter, remove and replace these Terms, from time to time, at its discretion, with no need to obtain your prior consent. The binding text of these Terms appears on the Site from time to time. You are responsible for keeping up to date on changes, if any, that may be made in these Terms. Continued use of the Site after making any such change will constitute proof of your confirmation of receipt of the changes.
Any dispute, complaints and claims in connection with the Site, including but not only in connection with the information and the content contained therein, shall be litigated under the laws of the State of Israel. The exclusive jurisdiction on any matter concerning these Terms and use of the Site is vested in the courts of the city of Tel Aviv - Yafo, and the parties expressly deny the authority of any other court in this regard.
To the extent any of the provisions of these Terms shall be held by the court to be illegal and/or invalid, that shall not invalidate any other provisions of these Terms and/or the other parts, which were not cancelled or reduced, of a certain provision that was cancelled or reduced by the court.
Any delay on the part of the Forum in exercising any right due to it, or non-insistence on any right due to it under these Terms, or any law, shall be ex gratia only, and shall not serve or be considered as a waiver by the Forum of any such right.
